Terms of Service

1. Acceptance of Terms

By creating an account or using StillSparkly, you agree to these Terms of Service. If you do not agree, please do not use the app. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to use StillSparkly. By using the app, you represent that you meet this age requirement and have the legal capacity to enter into these terms.

StillSparkly is currently available only to buyers and sellers based in the United States. By creating an account, you represent that you reside in the United States. We don't support buyers or sellers outside the US yet.

3. Your Account

You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account.

4. Listings & Transactions

Sellers must accurately and completely describe each item, including its condition, materials, gemstones, and any flaws. In particular:

  • The metal and gemstone details must reflect the actual item. Simulated, synthetic, or lab-created stones — including moissanite, cubic zirconia, and other diamond simulants — must be identified as such and may not be listed, titled, or tagged as natural diamonds or other natural gemstones.
  • Titles and categories must match the item. For example, a ring may not be listed as “studs,” and the listed jewelry type, metal, and stone must correspond to what is actually being sold.
  • Photos must be of the actual item offered for sale.
  • All items must be authentic. Counterfeit, replica, or misrepresented items are strictly prohibited.

Buyers agree to pay the listed price plus applicable shipping. StillSparkly charges sellers a commission of 8% on each sale, deducted from the seller's earnings. Listings that are inaccurate, incomplete, miscategorized, or that misrepresent a stone or metal may be edited, held, or removed under Section 5.

5. Listing Standards & Content Moderation

StillSparkly is a curated marketplace for quality jewelry. To maintain that standard, we may review any listing before or after it becomes visible to buyers. We reserve the right, at our sole discretion, to edit, recategorize, hold for review, hide, or remove any listing that:

  • inaccurately describes the item, its materials, or its gemstones;
  • mislabels a simulated or lab-created stone (such as moissanite or cubic zirconia) as a natural diamond or natural gemstone;
  • is miscategorized, incomplete, or of low listing quality — for example, a missing or incorrect metal or stone type, a mismatched title, or missing or poor-quality photos;
  • appears to be mass-produced or drop-shipped merchandise rather than the curated jewelry StillSparkly is intended for; or
  • otherwise violates these Terms.

When we hold or remove a listing, we will notify the seller by email or in-app message and, where appropriate, give them an opportunity to correct and resubmit it. Repeated or serious violations may result in suspension or termination of the seller's account under Section 12.

6. Payments & Payouts

Payments are processed through Stripe. Seller payouts are handled via Stripe Connect, which requires a US bank account and US tax ID (SSN or EIN) before any earnings can be paid out. StillSparkly does not store credit card information. All prices are listed in US dollars. Refunds are handled according to our return policy.

7. Shipping

Sellers must ship items within 3 business days of receiving an order. A flat shipping fee of $5.50 applies to all orders. Shipping labels are provided through the app. Sellers are responsible for packaging items securely.

8. Returns & Disputes

Buyers may open a return request within 3 days of delivery if the item is significantly not as described. The seller can share their side of the story, then our team reviews and makes the final call. If approved, the buyer ships the item back (with a generated return label or on their own) and receives a full refund once the item is returned. If a generated label is used, the label cost is deducted from the refund.

9. Prohibited Items

The following items may not be listed: counterfeit or replica jewelry, stolen goods, items containing hazardous materials, items that violate any applicable law, and non-jewelry items.

10. Prohibited Conduct

You may not: manipulate reviews or ratings, create multiple accounts to circumvent restrictions, harass other users, use the platform for money laundering or fraud, scrape or collect data from the app, or interfere with the app's functionality.

11. Intellectual Property

The StillSparkly name, logo, and app design are our intellectual property. By listing items, you grant StillSparkly a non-exclusive license to display your photos and descriptions on the platform and in marketing materials.

12. Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate accounts that violate these terms. Upon termination, active listings are deactivated and any pending balance must be settled.

13. Limitation of Liability

StillSparkly is a marketplace platform connecting buyers and sellers. We are not a party to transactions between users. We are not responsible for the quality, safety, or legality of items listed. Our liability is limited to the fees collected by the platform.

14. SMS & Text Messaging

StillSparkly offers an optional text-to-list feature that allows sellers to create listings by texting photos to our platform. By providing your phone number in your account settings and checking the SMS consent box, you agree to receive transactional SMS notifications from StillSparkly as part of the listing creation process, including photo receipt confirmations and draft listing ready alerts. You may also receive a one-time verification code when setting up your phone number.

Message and data rates may apply. Message frequency varies based on your usage of the text-to-list feature. You can opt out at any time by replying STOP to any message. Reply HELP for assistance. Opting in to SMS is not required to use StillSparkly. For support, contact support@stillsparkly.com.
